Entrants will be deemed to have accepted these Terms and Conditions and agreed to be bound by them when entering this Competition.

Who can enter

  1. This Competition is open to all residents of UK and Ireland aged 18 or over and who have an active listing in an Etsy shop at the date of entry. To list products on Etsy, entrants will need to follow the links to open an Etsy Shop online at https://www.etsy.com/uk/sell. New sellers can receive 20 free listings by redeeming the code ETSYAWARDSUKIRELAND here. Use of the Etsy website and participation in this Competition is conditional on compliance with the terms of use specified at https://www.etsy.com/uk/.  

  2. Employees, and their immediate families, of the Promoter, John Lewis Partnership, Red magazine and associated agencies and companies, contractors or individuals may not enter this Competition. Maximum of one entry per person. Multiple or duplicate submissions of the same entry will be invalid.

How to enter

  1. To take part in this Competition, you must complete the application form on www.etsydesignawards.com/uk during the Promotional Period (defined below). You will need to provide all requested information, and incomplete forms will be disqualified.

  2. The “entrant” is the person whose name appears on the application form – only one individual’s name may appear on the entry form as the entrant. You must provide your name as it appears on your bank account in order that the cheque for any cash prize won may be cashed by you.

  3. When completing your application, you should identify which Award(s) you wish to apply for, as guided by the questions on the application form. Please make sure you are eligible for the Award Categories you apply for by reference to the Eligibility Criteria, as non-eligible entries will be disqualified.

  4. If deemed eligible (in accordance with the Eligibility Criteria listed in Rule 12), you will be automatically entered into the New Etsy Talent, Retail Star and Regional awards.

  5. Your entry must comply with the Warranty and Usage terms at clause 18.

Promotion Period

  1. The Competition opens on 4th April 2016 and closes at 11.59pm (UK time) on 28th April 2016 (‘Promotional Period’)

People’s Choice Award

  1. Twelve finalists shall be selected for each of the above awards (excluding the Regional Awards). The finalists shall be featured on the Competition website www.etsydesignawards.com/uk on or before 23 May 2016. The public will be able to vote for their favourite entry by visiting the Competition website and using the Facebook mechanism. Each person (IP address) will be allowed up to one vote per week. You must not reward or incentivise anyone who votes for you – it must be a free and fair vote.  Entrants are permitted to promote their entry using social media, but may not use the Etsy “Convo” messaging system to do so. If the Promoter suspects or notices any suspicious or non-compliant activity in relation to any entry, whether by you or by third parties, you may be disqualified. The finalist receiving the most votes will win the People’s Choice award. They may or may not be a winner of another Award as well.

Votes must not be purchased by entrants.The Promoter reserves the right to request documentation, including a signed statutory declaration, from an entrant to confirm they have complied with these terms and conditions. If you fail to provide this documentation upon request you may be disqualified at the Promoter’s discretion.

  1. The Promoter reserves the right to substitute the prizes (or any part of them) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its control.  There is no cash alternative to the prizes (or any part of them) and unless agreed otherwise in writing the prizes are non-refundable and non-transferable. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

  2. If the Promoter is unable to contact a winner within 14 days of their being selected, if a winner is disqualified from the Competition or is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the Competition. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.

  3. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.

  4. The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  5. Cash prizes will be sent by cheque made payable to the winner as their name appears on the application form within 8 weeks of the applicable winner being notified.

  6. Prizes are not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry.

Materials - Warranty and Usage

  1. By submitting your entry, you warrant and undertake that:

  • excluding those intellectual property rights which are owned by or licensed to the Promoter:

(i) your entry and all materials presented or available from your Etsy Shop (“Materials”) are your own original work;

(ii) the Materials do not infringe any third party intellectual property rights of any third party; and

(iii) you are the legal and beneficial owner of all intellectual property rights in the Materials (including all images, footage, music and text submitted);

  • you have obtained all relevant rights and written permission from individuals featured in the Materials;

  • you hereby waive and agree not to assert (and warrant that all individuals featured have waived and agreed not to assert) any moral rights (or similar or equivalent rights anywhere in the world, including image rights) in and in connection with the Materials;

  • the Materials do not feature any items (including without limitation any animals) which are not your own property;

  • the Materials do not infringe English law or the law in the country in which you are normally resident and do not, to the best of your knowledge and belief, infringe the law of any other country;

  • the Materials comply with the Etsy Terms of Use available here: https://www.etsy.com/uk/legal/?ref=ftr  

  • the Materials do not contain any discriminatory, obscene or defamatory  material, does not include (whether by image, gesture, statement or other material of any kind) any violence, cruelty to animals, weapons, religious iconography or anything which may reasonably be considered to be offensive, anti-social, inflammatory or otherwise objectionable, and is not otherwise illegal under English law, or the law in the country in which you are normally resident;

  • you agree that the Promoter and its licensees may commercially exploit the Materials in connection with the Competition, or to promote your Etsy shop or to promote Etsy in general, in any formats and through any channels, without any payment to you.

  • you agree that the Promoter may, in its sole discretion elect not to publish, use or exploit the Materials or any part of them in any way and, if it does elect to publish, use or exploit the Materials or any part of them in accordance with these Terms and Conditions, the Promoter may, in its sole discretion, stop publishing, using or exploiting the Materials at any time, and may edit any material it considers in breach of these terms.

  1. The Promoter reserves the right to pass on any entry which causes it concern (including any associated personal details) to the relevant authorities, at its sole discretion and/or where such disclosure is required by law.

  2. You agree to indemnify the Promoter in respect of third party claims arising out of or in connection with any breach by you of the warranties and undertakings set out in these Terms and Conditions (in particular, the warranties and undertakings set out in clause 18 of these Terms and Conditions).

  3. The winner may be required to sign a statutory declaration regarding the originality of the Materials and/or rights to use all Intellectual Property in the Materials.

Promoter’s Liability

  1. Nothing in these Terms and Conditions in any way limit the Promoter’s (or any other person or organisation’s) liability for (i) fraud, or (ii) death or personal injury caused by negligence, or (iii) any other liability to the extent such liability may not be excluded or limited by applicable law.

  2. Except as set out in clause 22 above, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from:

  • any postponement or cancellation of the Competition, and

  • any changes to, supply of (including, without limitation, prizes which do not reach the intended recipient), or use of the prize, and

  • any act or default of any third party supplier,

  • any network, computer, hardware or software failures of any kind which may restrict or delay the sending or receipt of your entry;

  • problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur whilst undertaking any travel won on or connected with their entry; in the participation in any prize; as a consequence of late, lost or misdirected mail, email SMS or phone call; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; any injury or damage to entrant's or any other person's computer software or phone; or any combination thereof, related to or resulting from participation or sending or receiving of any communication or of any materials in this competition;

  • late, lost or misdirected entries;

  • prizes damaged or lost in transit;

which are beyond the Promoter’s reasonable control.

General

  1. Winners agree to participate and co-operate as required in editorial activities relating to the Competition, including but not limited to being interviewed and photographed, and agree that the Promoter and its licensees may use their name and likeness for advertising and publicity purposes without additional remuneration.

  2. Winners will be required to discuss their story with the Promoter, and participate in promotional activity including publishing their story and participating in photography shoots on reasonable notice during the period from 10 June to 31 October 2016.

  3. The Promoter reserves the right to amend these Terms and Conditions at any time.

  4. If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the Competition, choice of prize winner(s) or any Entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.

The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into.

  1. Details of prize winners’ names and county will be available for one month after the close of the Competition by writing to the Promoter at the address set out above and stating the name and closing date of the Competition.

  2. Please note that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.  By entering, you acknowledge that Facebook bears no responsibility for this Competition and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Competition.  You understand that the information you provide is provided to the Promoter (and its affiliates, associates and agents where applicable) and not to Facebook.

  4. This Competition, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Competition.
